the oil rig exploded on the night of april 20th, 2010. eleven workers were killed in the fire. 172million-gallons of oil gushed into the gulf of mexico. bp will pay $4.5 billion in fines. two employees? charged with manslaughter. one with lying to congress. cbs news reporter on what bp knew before the explosion. >> reporter: the two former bp employees charged with manslaughter were the highest ranking bp supervisors on deep water horizon. the test found signs that combustible gas was seeping into the well. the indictment alleges bp managers robert kaluza and donald failed to call these on shore. they allowed work on the well

to continue. want gas came up the well and exploded. u.s. attorney general eric holder. >> this is an indication that we have shown and the company has admitted as a result of their actions people died there unnecessarily. >> reporter: federal authorities also charged david rainey about lying to investigates. rainey insisted 5000-barrels of oil were leeing every day when he was aware they estimated it was leaking 82 -- >> withheld other documents altogether and lied to congress and others to make this spill appear less catastrophic than

it was. >> reporter: shelly anderson's husband jason died in the explosion. it was supposed problem his final day. >> i wish that we would have been able to have our day in court and that i would have been able to tell a jury exactly what our loss is. how much we miss jason. >> reporter: next thursday thanksgiving would have been his 38th birthday. >> we will never forget what jason means to us and that he's gone and that he's never coming back. we live with that every single day. >> reporter: the three men charged say they are innocent. the lawyer for one of the men called his client a scapegoat. bp's settlement ends criminal prosecution of the company. bp could still face another $20 billion in fines if it loses a civil lawsuit next year. >> all that pain that california drivers faced at the

pump this year may not have been necessary after all. you always thought it. that is according to an exhaustive study. many refineries were operating at times when the companies said they were offline. with just 7 companies controlling 94% of the market in california, state senator mark leno says it's cause for concern. >> when a market place gets more concentrated the opportunity for that market manipulation only increases. >> leno has launched an official investigation into the california refinery season and its oversight. he says there's not enough evidence to prove collusion. but there's also no watchdog agency in place to keep an eye on them. >> israel continued a blistering rocket assault on what it described as 100 terror sites in gaza.

tanks and troops are positioned along the border. the battle is escalating. israeli commanders call it payback for on going rocket attacks. all of this is raising fears of a wider region corral conflict. the un security council is urging maximum restraint from both sides. the white house is backing israel. the angry conflicts spilled in the streets of san francisco. a small contingent came out in support of israel. a larger pro palestinian group came pout. >> they need to stop. military attack on gaza strip. the message for the american people. they need to take a stand. >> the protesters also called

on president obama to end u.s. aide to israel. >> members of congress saw the attack on the u.s. consolate in benghazi firsthand. that was recorded on security cameras. cbs news reporter david martin's sources told him what they show. >> reporter: the first video of the attack was captured by cell phones. it took about 10 more days for the fbi to get its hands on video taken by security cameras. that class fewed video shown to the house and senate intelligence committees answers sop of the questions surrounding the attack. a u.s. intelligence official shows it has no sign of how it -- the attack was not well planned. the attackers did not know the layout of the compound.

the attack lasted about an hour. the surviving americans retreated to a cia safe house about a mile away where they continued to take fire from small arms and rocket propelled grenades. after another hour the shooting stopped. for four hours no shots were fired giving the rescue team time to make its way to the annex. ten minutes after they arrived a second attack again. this time with mortars. that attack was also captured on video both by security cameras and a drone. it shows a more organized and deliberate assault. intercepted phone calms and text messages indicate some of those were inspired in part by televised scenes of protesters in cairo in rage other an anti- muslim video running on the

internet. others seem to have nothing more in mind than looting. that first attack created an opportunity for the second attack. whether it was planned that way all along is not clear. u.s. officials say the four hour lull gave the attackers time to bring up more fire power. they fired five rounds. the first two missed. the next three hit. david martin, cbs news, the pentagon. >> at least four wounded veterans were killed today when a train hit a parade float in midland, texas. the accident happened as the wounded warrior ares were taken part in a parade. as it crossed other some railroad tracks they were hit by an on coming train. an eyewitness says the parade got stuck on the tracks. >> the gates actually hit the first people on the trailer. started going back up. it wasn't i say 8 to 10 seconds

later the train blew through the end of the trailer. >> at least 10 other people are in critical condition tonight. the parade was supposed to end at a hunt for heroes banquet. the wounded service members were then going to be treated to a deer hunting trip this weekend. >> a double murderer offered statements to the jury. nathaniel burris is facing the death penalty for the death of his girlfriend and her friend. he was convicted of those killings last week. family members are trying to find comfort where they can. >> what gives me peace is the woman he loved, they fell in love, they died the same day, they were buried the same day. i think they've gone to heaven to live together forever. >> burris told jurors to give him the death penalty because

he deserves it. >> the alcohol related death of a chico state student sparks an unprecedented move. the suspension of all fraternities and sororities on campus. the decision comes after a series of problems with underage drinking, hazing and fighting. latest incident the death of mason sumnick. the university says he tried to take 21 shots of alcohol for his 21st birthday. he suffered brain damage and today died. >> mason's loss has enabled me to provide a wakeup call for everyone. >> shutting down the greek system is shutting down any plan tropic activities. >> eight years ago the campus president warned students there would be no second chance. fraternities and sororities can apply for reinstatement in the

>> reporter: we're talking movie pirates here. it's not just fans lining up for big block busters. movie pirates are striking at the first showings. some theaters are hiring undercover investigators to catch them red handed. a 007 wasn't the only spy in the theater. private investigators were watching on surveillance video when police say a movie goer set up a tripod and camera and started reporting the movie. brazen act of alleged piraisy. the motion picture association of america says it's one of the best ways to catch them in the act.

how much are they? >> $5. >> reporter: the streets are where movie pirates make their profit. we found dozens of movies for sale. some still in theaters. nine out of ten are recorded in theaters before being uploaded online or packaged and sold on the cheap. theaters are patrolling for pirates at midnight showings of block busters. one rep told us it's a serious threat to the industry. we're after the professionals who are out to make a profit. investigators will be watching. despite that security you might have guessed pirates still slip through the cracks. we did find that twilight movie is already online and ready to be downloaded for those who are willing to break the law.

say the company stopped paying into their pension fund. the 70 workers in this bakery which produces bread voted to go on strike last week. >> cup cakes and the bread, made good quality stuff. good quality products. and we mate hate to see it come to an end. enough is enough. >> reporter: a hostess spokesman says production has been crippled at a dozen of its plants. the company is already facing tough times. but workers think the company is bluffing about the threats to shut everything down if they don't go back to work. >> i don't think they'll close. i think they'll come to their senses. corporations are in business to make money. closing plants, liquidating you don't make any money. >> this is a fight against 7 eleven. one bay area neighborhood is

doing all it can to keep that store from going up. why neighbors are saying no to big gulps and beef jerky. >> reporter: the machine, hot dog warmers are in place. but the newest 7 eleven hasn't even opened yet and it's already facing a big gulp of community anger. >> we were told by the developers we're going to put in another market. they lied to us. >> reporter: nearly 150 people packed into a city council meeting where the neighborhood association showed photos of robberies, loitering and squatters at other 7 elevens trying to convince the council the stores are for crime. >> this is the kind of crime. it's only going to get worse by people who have no regard for
